Telehandler driver sentenced over death of colleague

A self-employed telehandler driver has been sentenced after reversing over and fatally injuring a colleague on a construction site in Cheshire. James Connolly, 49, a lift supervisor, died after being struck by the vehicle at a site in Ince, Ellesmere Port, in June 2023. [press.hse.gov.uk], [thebusinessdesk.com]

A Health and Safety Executive (HSE) investigation found that experienced operator Michael Nixon chose to reverse the telehandler without the assistance of a banksman, despite an unobstructed turning circle being available. Investigators also found he had been using his mobile phone while operating the vehicle, contrary to site rules. [press.hse.gov.uk], [hsmsearch.com]

Nixon, 46, pleaded guilty to breaching Section 3(2) of the Health and Safety at Work etc. Act 1974. He was sentenced to 12 weeks’ imprisonment, suspended for 12 months, fined £800 and ordered to pay £2,000 in costs at Warrington Magistrates’ Court. [press.hse.gov.uk], [thebusinessdesk.com]

The case is a stark reminder of the devastating consequences that can result when vehicle safety procedures are ignored. Workplace transport incidents remain one of the leading causes of fatal injuries on UK worksites, underlining the importance of following site rules, avoiding distractions and using appropriate controls when manoeuvring vehicles. Shareable takeaway:
One moment of distraction can change lives forever. This tragic case reinforces the need for strict adherence to workplace transport safety rules, including avoiding mobile phone use and ensuring safe reversing procedures are followed at all times.
