HMO Landlord Prosecuted for Serious Fire Safety Failures

A private landlord has been successfully prosecuted after serious fire safety and housing management failures were uncovered at a House in Multiple Occupation (HMO) in Lincoln. The case highlights the importance of landlords meeting their legal responsibilities to ensure tenants live in safe and secure accommodation. [fsmatters.com], [thefpa.co.uk]

The prosecution followed complaints from tenants about conditions at the property. After an inspection in January 2025, Lincolnshire Fire and Rescue identified immediate fire safety risks. Subsequent investigations by the City of Lincoln Council revealed multiple hazards, including fire safety breaches, electrical dangers, damp, and significant disrepair. Due to the serious risks posed to occupants, the council served an Emergency Prohibition Order on the property. [fsmatters.com], [thefpa.co.uk]

Landlord Anita Sharma pleaded guilty to seven breaches of the Management of Houses in Multiple Occupation (England) Regulations 2006. During sentencing at Lincoln Magistrates’ Court, Sharma was fined £4,000, ordered to pay £2,000 towards the council’s costs, and an additional £800 victim surcharge was imposed. A second individual acting on behalf of the landlord also received a simple caution relating to an offence under the Protection from Eviction Act 1977. [fsmatters.com]

Councillor Donald Nannestad, Portfolio Holder for Quality Housing at City of Lincoln Council, said the case demonstrates the council’s commitment to protecting tenants and taking action against landlords who fail to meet legal standards. He emphasised that everyone deserves to live in a safe, secure, and well-maintained home. [fsmatters.com], [thefpa.co.uk]

This prosecution sends a clear message that fire safety failures and poor housing management will not be tolerated, and that authorities will take robust enforcement action where tenants’ health and safety are put at risk. [fsmatters.com], [thefpa.co.uk]
